Dan Air (code DN) is a Romanian airline based at Bacău Airport, which is within the European Union: Regulation (EC) No 261/2004 applies to all its flights departing from the EU and those arriving in the EU.
When you are entitled to compensation from Dan Air
- The flight arrived at its final destination with at least 3 hours delay (the arrival time counts, not the departure time).
- The flight was cancelled and you were notified less than 14 days before departure.
- You were denied boarding (overbooking) or missed a connection within a single booking due to a delayed flight.
- Amounts: €250 for flights up to 1,500 km, €400 between 1,500 and 3,500 km (and for all EU flights over 1,500 km), €600 for flights over 3,500 km.
- You do not receive compensation if the delay was caused by weather, an air traffic control strike, or other extraordinary circumstances. Technical defects and airline staff strikes are not considered extraordinary circumstances.
- In Romania, you have 3 years from the flight date to claim your money.
How to claim the money yourself from Dan Air
- Send a written request via the contact channels on dan-air.com, including your name, booking code, flight number and date, boarding pass, the amount requested (Art. 7 of Regulation (EC) No 261/2004), and your IBAN.
- Keep proof of submission (the sent email or a confirmation of receipt).
- If you do not receive a response within 30 days or if your claim is rejected, file a complaint with ANPC for flights departing from Romania. The Bacău Consumer Protection office has already sanctioned the airline dozens of times for unpaid compensation, so complaints really do matter.
Assignment and representation at Dan Air
Dan Air is a Romanian company, so the Civil Code applies: you can assign your right to compensation without the company's consent, and the assignment takes effect once the company receives written notification (Art. 1566 and 1578).
