HiSky compensation: delayed or cancelled flight

HiSky operates from Romania under two codes: H4 (HiSky Europe, a Romanian-licensed airline, therefore an EU airline) and H7 (HiSky from the Republic of Moldova). For H4 flights, Regulation (EC) No 261/2004 applies, regardless of where the plane lands. For H7, it applies only when the flight departs from an EU country.

When you receive compensation from HiSky

• The flight arrived at its final destination with at least a 3-hour delay (arrival time counts, not departure time).
• The flight was cancelled and you were notified less than 14 days before departure.
• You were denied boarding (overbooking).
• Amount: €250 for distances up to 1,500 km, €400 between 1,500 and 3,500 km, €600 over 3,500 km (e.g., Bucharest – New York).
• You do not receive compensation if the delay was caused by weather, an air traffic control strike, or other extraordinary circumstances.

Pay attention to the HiSky rights page

On the HiSky website, a flight is called "delayed" based on the departure time (2, 3, or 4 hours). This is the rule for assistance: meals, drinks, hotel. For compensation, the CJEU (the Sturgeon case) has established that it is calculated based on the arrival time: a minimum of 3 hours at the destination.

How to claim your money from HiSky

1. Write to [email protected], in Romanian, English, or Russian.
2. Send: name, flight number and date, booking code, boarding pass, the amount requested (Art. 7 of Regulation (EC) No 261/2004), and your IBAN.
3. HiSky must respond within 30 days of receiving the complete request.
4. If they refuse or do not respond, you can file a complaint with ANPC (for flights departing from Romania).

Assignment of the right to compensation

HiSky's terms (Art. 20) state that the right to compensation cannot be assigned to someone else. For compensation under Regulation (EC) No 261/2004, the CJEU decided that such clauses do not apply (case C-11/23, February 2024), and even Art. 20.1.3 of HiSky's terms makes an exception for exercising rights under the regulation.
